American jurist Benjamin N. Cardozo (1870-1938) typed and signed this friendly letter to Harold Roland Shapiro
, telling him: “I was glad to get your letter and also your little article on the Appalachian Coals decision which I have read with interest.”
Cardozo was the Chief Judge of the New York Court of Appeals (1927-1932) until being nominated to serve as an Associate Justice of the Supreme Court of the United States (1932-1938) by President Herbert Hoover. Cardozo is remembered for influencing the development of American common law in the 20
th
century, for forming part of the liberal bloc of justices known as the Three Musketeers (justices who supported FDR’s New Deal), and for his vivid prose style.
The Appalachian Coals decision refers to the 1933 Supreme Court case,
Appalachian Coals, Inc. v. United States
, in which a group of coal producers attempted to come together and create a corporation to be the exclusive selling agent of their coal. A District Court ruled that the corporation would act as a price-fixing cartel and created an injunction against it, which was then appealed. The Supreme Court decided that Appalachian Coals, Inc. would not be in violation of the Sherman Anti-Trust Act and reversed the injunction. This letter was written 15 days after the Supreme Court decision.
Typed on a 7 7/8” x 5” sheet of “Supreme Court of the United States Washington, D.C.” imprinted stationery.
